Terms of use

The short version. Play the game on your own devices, as much as you like. Do not sell it, take it apart to republish it, or cheat other people with it. It is a game, offered as it is, and your progress is yours to keep or wipe.

1. Agreement

These terms are between you and Team Mio ("we", "us") and cover the Tumble Post game for iOS and Android ("the game") and this website ("the site"). Installing or playing the game means you accept them. If you do not, do not install it, and uninstall it if you already have.

The game is also subject to the terms of the store you obtained it from — Apple's App Store or Google Play. Where a store's terms require something stricter of you, those terms apply as well.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own entertainment. That is the whole of what is granted; everything not granted is reserved.

3. What you may not do

Recording, streaming and video of your own play is welcome and needs no permission from us.

4. Ownership

The game, its source, its artwork, its soundtrack and the Tumble Post name remain ours and our licensors'. This licence does not transfer any of it to you.

5. In-game credits

Credits, ratings, airframes, liveries and upgrades exist only inside the game. They are not currency, not property and not redeemable for anything of value. They cannot be bought with real money — the game has no in-app purchases — and they may be changed, rebalanced or reset by an update.

6. Your save data

Your progress is stored on your device and nowhere else. We hold no copy and cannot restore it. Uninstalling the game, resetting the record from Settings, switching devices or clearing the app's storage will lose it permanently. Keeping a device backup, if your platform offers one, is up to you.

7. Updates and availability

We may update, change or stop distributing the game at any time. Updates may alter behaviour, balance and features. We do not promise that any particular version remains available, or that the game will run on every device or every future operating system release.

8. No warranty

The game and the site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the game will be uninterrupted, error-free, or free of defects, or that defects will be corrected.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for lost data, lost progress or lost profits, arising out of or connected with the game or the site, whatever the theory of liability and even if we were told such damage was possible. Where liability cannot be excluded, it is limited to the amount you paid for the game, or to the minimum the law permits, whichever is greater.

Some jurisdictions do not allow certain exclusions or limitations, so parts of sections 8 and 9 may not apply to you. Nothing here removes rights you hold as a consumer that cannot lawfully be waived.

10. Ending the licence

Your licence ends when you uninstall the game, and we may end it if you breach these terms. Sections 4, 8, 9 and 11 survive that ending.

11. Changes to these terms

We may revise these terms. The current version always sits on this page with its effective date at the top, and continuing to play after a revision means you accept it.
